NYC-Specific

    Zoning Use Group

NYC's Zoning Resolution divides all land into use groups (1-18) that define permitted activities. Restaurants and bars typically fall under Use Group 6 (retail and service) or Use Group 12 (entertainment). The zoning district of your property determines which use groups are allowed. For example, C1 zones permit Use Group 6 (restaurants) but may not permit Use Group 12 (nightclubs with dancing).

    Why It Matters for Operators

Zoning is the first filter for any hospitality site selection. If your concept isn't permitted under the property's zoning designation, you cannot operate there regardless of what the landlord promises. Zoning variances are possible but expensive ($25,000-$100,000+) and time-consuming (12-18 months). Always verify zoning compatibility before entering lease negotiations.

    FWDRE Insight

Don't rely on the landlord's representation of permitted uses—verify independently through the NYC Zoning and Land Use Map (ZoLa). Pay special attention to 'commercial overlays' in residential zones (C1-1 through C1-5), which permit retail uses but may restrict restaurant size, hours of operation, or late-night entertainment. Manufacturing zones (M1) can be surprisingly restaurant-friendly.
