    Place of Assembly (PA) Permit

    A Place of Assembly (PA) permit is required by the NYC Department of Buildings for any establishment where 75 or more people gather for purposes of entertainment, recreation, instruction, or worship. This includes large restaurants with entertainment, nightclubs, event spaces, large fitness studios, and performance venues. The application requires DOB plan approval, FDNY sign-off, and compliance with accessibility standards.

    Operating a venue that requires a PA permit without one can result in immediate closure, significant fines, and criminal liability. The permitting process typically takes 6-12 months and costs $15,000-$40,000 in filing fees, architect costs, and expediting fees. Your C of O must also reflect the assembly use. This is a common oversight for restaurant operators who add live entertainment after opening. Note: the PA permit is separate from the former PCE (Physical Culture Establishment) special-permit regime for gyms, which NYC eliminated in December 2021 — most fitness uses are now as-of-right where permitted, subject to district-specific rules.
